“Le Dressing”, is a sole trade entrepreneur activity, having its main office 2, rue des Orangers 98000 Monaco and registered at the Monégasque companies registrar under the registration number 01P06605 (hereinafter referred as “Le Dressing” or “we, “our”, us”).
Le Dressing is operating a website (hereinafter referred to as “the website)” dedicated to pre-worn women’s clothing including related fashion accessories such as handbags, watches, bracelets or necklaces (hereinafter referred to as “Item(s)”). Le Dressing offers services (hereinafter referred to as “the Services”) through which you may purchase items that are displayed on our website.
The present terms and conditions have for purpose to govern the relationship between the Users (hereinafter referred to as “Users”, “Customers” or “You”) and Le Dressing when using its services. These Terms and Conditions may be amended and updated from time to time, without any prior notice, and become effective once they have been posted on our website. It is then of your own responsibility to check the latest version of theses terms, prior to using the services.
By using the website or setting up an account, you acknowledge to be bound by the present terms and conditions and also agree to comply with all the provisions stated therein. Otherwise, you shall not use the service.
Le Dressing reserves the right to terminate or suspend the use of its services to any Users that shall not comply with the present terms, at its own discretion. Le Dressing also reserves the right to modify or discontinue its service at any time without prior notice. For such action, Le Dressing is not liable to you or any third party.
The use of the website is strictly reserved to Users that have reached the age of 18 years and above as stated in Article 410-1 of the Monegasque Civil Code.
For using our service and placing an order, you must be resident in one of the European Union countries or in Switzerland or in Monaco. Otherwise, please contact directly our Customer service at the following email address: ledressing@monaco.mc.
Prices are expressed all taxes included. Nevertheless, additional costs are to be expected, as shipping and insurance costs are not included in the original item price. The shipping cost is calculated in function of the purchased item and the geographical location of the User.
Please note that an insurance fee is applicable for the insurance policy on the items shipment which cost varies depending on the value of the items being shipped. The insurance cost is included in the shipment cost displayed on the website.
By using our Service, you understand and accept that prices displayed on our website may vary from the prices displayed in our store. Le Dressing reserves the right to change at any time the prices offered on its website. It shall not be liable to you or any third-party for such price change or for removing one of its items from the website.
Prior to placing an order:
In order to use our website service, a customer shall first create an account or provide all required transaction information such as requested when placing the order or creating the account (full name, age, billing address, contact details, payment information…).
For the purpose of using our service, you agree to provide accurate personal information for all purchases made or for creating your user account. If a change should occur in the information provided, you agree to promptly update them including your email or billing address. Le Dressing reserves the right to ban any user that would have provided a factious name or false personal information and shall initiate any legal actions deemed appropriate against the User if such infringement was to occur.
The submission of personal information is governed herein by our Privacy Policy. YOU MAY NOT USE OUR SERVICE PRIOR to READING THIS SECTION AND AGREE ON THE TERMS AND CONDITIONs APPLICABLE TO THE PROCESSING OF YOUR PERSONNAL INFORMATION.
Order confirmation:
Upon placing an order, the Customer shall receive an order confirmation email on the contact email address provided to Le Dressing, meaning that Le Dressing has received your order and will process it shortly. However, your order will only be validated once your payment information has been authorized and that the monies are physically on our merchant account.
Please note that Le Dressing is entitled to refuse any transaction without motivation. We may, at our sole discretion, limit or cancel quantities purchased per order, per household or per user. If such a case scenario occurs, we will notify you, no later than 4 days after receiving the order confirmation email, on the e-mail and/or billing address/phone number provided at the time the order was made. If the payment has been received by Le Dressing, the refund to the Customer will be done according to our refund policy.
We reserve the right to limit or cancel the sale to any person that is using our service out of the geographical region stated in our minimum requirements.
Le Dressing is offering items and products for sale on its website. These items may have a limited quantities and we may at any time withdraw items or cancel an order when such items are not available anymore in our store.
We have tried to best of our ability to provide a very detailed and accurate description of the items displayed on our website including the size, manufacturing material or brand model. Nevertheless, the appearance of the items’ images may be different than the reality due to your computer monitor’s display. We therefore cannot guaranty that the display of a color will be 100% accurate.
The customer must check the goods upon delivery, by opening the shipment parcel upon receipt by the carrier and checking the status of the item, in order to refuse the goods in case of damage. If the goods are not conform or damaged, the buyer must notify us immediately upon receipt of the shipping parcel, by returning the goods in accordance with our return & refund policy.
We commit to process your order within fifteen (15) business days following the confirmation email sent by us by e-mail to your registered e-mail address. Otherwise and beyond this period, you are entitled to cancel your order and ask for the refund of your purchase in accordance with our refund policy.
The shipment will be made according to the shipment details you have provided when placing your order. Le Dressing shall not in any case, be responsible, for any mistakes made by the User when providing his/her shipping information. All costs incurred by such mistakes shall be at the customer’s expense and will be directly levied on your credit card when applicable.
Le Dressing uses well-known courier delivery service companies for the order shipment. Shipment costs and timing depend on the delivery method selected when placing your order. All shipments are tracked, insured and require signature confirmation upon delivery. If you notice any appearing damage on the package, please refuse the shipment and contact us as soon as possible and not later than 2 business days from the date of receipt of the item (as proven by the postal tracking number).
Le Dressing has subscribed to a relevant insurance policy to comply with applicable laws for such kind of business and shall accept any claim related to damage occurred during the shipment of the item.
Le Dressing accepts all returns of all purchased items on its website subject to the condition that the items are identical to the product description (including le Dressing tags).
When returning an order, the Customer shall comply with the following process :
1. A return request shall be filed by email to ledressing@monaco.mc within 7 business days of receipt of the item (as proven by the postal tracking number).
2. Items must be sent back to the following address : LE DRESSING 2, rue des Orangers 98000 Monaco. In case of a claim and/or a withdrawal from the sale, the Product must be returned complete in the original packaging with all its accessories and documents, its labels and seals duly affixed, in an identical or similar packaging to that of the original consignment. In any event, the Product must be returned in the same state as when it was sent out.. The Customer shall use an express courier delivery service and items must arrive at Le Dressing within 7 days upon filing a return request.
3. Should the Buyer return a Product and should his request for reimbursement be approved, then subject to the checks conducted by Le Dressing’s to ensure that the returned Product is indeed the Product that was delivered and that it was not deliberately damaged, Le Dressing shall instruct the escrow agent to reimburse the Transaction Price. This reimbursement shall take place within thirty days following the date of the claim or of the withdrawal from the sale.
Shipments fees will not be refunded by Le Dressing, which you agree to by placing a return request.
Deceptive items
Before any item is listed online, it is first examined and authenticated by our in-house team of experts who have collaborated with the most prestigious auction houses in the world. Please, note that Brands we carry are not involved in the authentication process as we resort to independent experts. We are not an authorized reseller and therefore, Brands are not responsible for any products purchased through our website and do not guaranty the authenticity of the goods sold.
Le Dressing commits to fully reimburse you if any of our items is proven deceptive or counterfeit by an expert authentication from a third-party after this expert has been first approved by Le Dressing.
Please provide your claim on forfeited item to our customer service department by email to ledressing@monaco.mc, within 2 business days upon receipt of the said item.
Note that Le Dressing will accept claims on deceptive items subject to the Customer providing a detailed and clear account of the reasons for their claim. If reasonable indication shall justify the customer’s claim, Le Dressing will notify the User to send back the purchased item. The expert authentication shall be provided within 15 business days upon receipt of the item.
If the item proves to be counterfeit following such an expertise, Le Dressing will reimburse the customer’s purchase, including expertise carried out by Le Dressing and shipping costs.
Customer refund for deceptive items shall be governed under our Returns Policy as stated above.
Hidden defects:
Pursuant to article 1483 Monegasque Code Civil, Customers are entitled to be fully refunded when items contain one or more hidden defects (such defect is considered as such when preventing the item’s use under normal conditions of the item).
Hidden defect claims are governed under the same conditions as stated for deceptive items.
Refund
For all the aforementioned cases, Le Dressing will proceed when appropriate, to the purchase refund using the payment source initially used by the Customer, within 30 business days and upon validation of the proven case.
Our online e-commerce platform provides the Customer with a direct payment gateway. When placing your order, you may chose among different payment methods via debit or credit card. Should you wish to pay via bank transfer for an item, please contact Le Dressing directly at ledressing@monaco.mc.
Once the order is confirmed, the payment is immediate and is not subject to the prior shipment of items. Please note that transactional purchase limit on our website is capped at 3.000€ applicable tax included. A purchase summary is provided in the order confirmation email. A purchase invoice can be issued upon request to the following e-mail address: ledressing@monaco.mc.
Le Dressing excludes all limitation of liability or clause excluding liability when such limitation is considered as abusive by its nature in consideration with the laws in force in the Principality of Monaco.
However, for the use of its website service, the Dressing does not guarantee that service will be uninterrupted, timely, secure or error-free.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Le Dressing, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Nevertheless, Le Dressing will assume its liability for any damages or injury that would a customer would suffer from by selling one of its items, excluding any subsequent resale.
Therefore, Le Dressing is not responsible for indirect loss that may occurs following the destruction of the item for which it is not involve. Besides, Le Dressing cannot be deemed as responsible for the breach of one of its obligations such as the delivery of items when such failure is due to force majeure or an event beyond its reasonable control, including and not limited to fires, floods, storms, riots, strikes, civil commotion, war and terrorist activity.
If these present terms & conditions and their application would be considered as illegal in the light of the applicable laws, we commit to compensate for any losses caused by this breach that can be reasonably expected.
Our website or services may contains typographical errors, inaccuracies or omissions that may relate to product availability, descriptions, pricing, offers and shipping policy.
Le Dressing reserves the right to correct at any time, without prior notice to you, any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in relation with the service or products is inaccurate (including after you have submitted your order).
In the event that any provision of these Terms of Service is deemed to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
All information and contents display on our website is the sole ownership of Le Dressing. Furthermore, any other intellectual property right of any nature whatsoever associated with the website, as well as those related to the underlying software code are owned either directly by Le Dressing or its licensors.
By using the website and our services, you are strictly prohibited to use or change, attempt to copy, reproduce, alter, modify, perform reverse engineer, disassemble, decompile, transfer, exchange or translate the software code, or to create derivative works of such rights of any nature whatsoever by any means without our prior written permission.
Le Dressing offers second hand items for sale from luxury fashion brands, although we are not in any way nor in any case, authorized reseller of such Brands. All intellectual property rights belonging to these brands are fully registered and shall not in any way be used, reproduced, copied without their prior approval. It is understood that Le Dressing does not claim and has no rights or license of any kind on the intellectual property right of the items that are sold on its website.
Le Dressing, pursuant to the Monégasque law No. 1.165 of the 23rd of December 1993 on the protection of personal information ((hereinafter “Personal Information”), amended by the Law No. 1.353 of the 4th of December 2008, has submitted a Declaration at the Commission of Control on Personal Data Information and thus complies with the laws in force regarding the protection of personal data;
In order to operate the website services, we collect and process Personal Information provided by the users and customers such as full name, date of birth, gender, billing and shipping address, contact details (email, phone/mobile number) password or browsing history.
Your Personal Information are collected for the following purposes:
ϖ To Ensure our sale services and follow-up;

By using our Services and website, you acknowledge that your personal information may be transferred or disclosed to such third-party providers.
Access to your Personal information can be granted to juridical authorities when investigation possible criminal offense.
Pursuant to Article 14 of the Monégasque Law No. 1.165 of the 23rd of December 1993 modified, the User is, at any time, entitled to:

ϖ Refuse the communication of his/her personal data to third parties;
ϖ Access to all of his/her personal data, processed under the Services provided by the Company;

For exercise of the above right, please kindly send a mail to le Dressing along with identification document (provide your full name, email address and comes jointly with a copy of your ID);
Without any reply from Le Dressing within 30-business day from the day you sent the letter for the exercise of your rights, Le Dressing may face incrimination stated into the provisions of the article 21 of the monégasque law no. 1.165 of the 23rd of December 1993 modified.
As for these Terms and Conditions, we reserve the right to modify this privacy policy at any time, without prior notifying you. Changes and clarifications will take effect immediately upon their posting on the website.
These Terms and Conditions are effective as long as you will use our Service or until transaction is fully executed meaning that the Customer cannot file subsequent claims against Le Dressing.
Early termination is also effective should Le Dressing have banned the User from using its services.

These Terms and Conditions are governed under Monegasque laws. In case no amicable agreement would be reached on a dispute between Le Dressing and the customer arising from the execution or interpretation of these Terms and Conditions, the Courts of the Principality of Monaco are competent.
